TERMS AND CONDITIONS OF THE PAY’S GIFT E-VOUCHER FULFILLMENT PROGRAM

1.0 Description

1.1 Coup Marketing Asia Pacific Sdn. Bhd. (Pay’s Gift) is the authorized fulfillment operator for e-Voucher products managing the Pay’s Gift Fulfillment Program (“Landing Page”).

1.2 Pay’s Gift scope of work include generating e-Voucher, managing the Landing Page, validating and verifying members’ promo codes, delivering e-Voucher via email to the eligible members, performing operational support to merchant’s outlets and supporting members upon redemption.

1.3 The following terms and conditions apply to your redemption, download and/or purchase of the e-Vouchers (“Terms and Conditions”) at the selected participating mobile applications be bound by these Terms and Conditions, including any term which may have been amended from time to time, without limitation or qualification.

2.0 Eligibility

2.1 This Landing Page is open to all registered members of the selected participating mobile applications and websites (“Customers”).

2.2 Customers can only redeem, download and/or purchase each type of e-Vouchers once.

2.3 Customers are entitled to purchase, redeem, download and/or purchase the e-Vouchers through selected participating mobile applications and websites (“Offer”).

2.4 Redemption of e-Vouchers are bound by the terms and conditions stated in the respective e-Vouchers.

2.5 The promotion code provided at the selected participating mobile applications and websites through its’ Offer is to be subsequently verified at the Landing Page which can be accessed at https://privilege.paysgift.com/ . Each promotion code can only be used once and Customers will be receiving the relevant link to access the e-Vouchers via email upon submission of their contact details.




3.0 Miscellaneous

3.1 Pay’s Gift, its employees and participating merchants shall not be liable to the Customers or any other party for any loss or damage of whatsoever nature suffered by the Customers as a result of participation or non-participation in this Offer or as a result of any act or omission on the part of Pay’s Gift in connection with this Offer. To the full extent permitted by applicable law, Pay’s Gift, their employees, and participating merchants shall not be liable for any indirect, consequential, incidental, special or punitive damages, including damages for loss of profits or revenues, business interruption or loss of business opportunities, arising from the use of or inability to redeem, download and/or purchase the e-Vouchers.

3.2 The e-Vouchers are provided on an “as is” and “as available” basis. Pay’s Gift makes no representation or warranty, express or implied, that the e-Vouchers or any feature at the selected participating mobile applications and websites shall always be reliable, timely, secure or defect free, or that the e-Vouchers will be available at all or any particular time. The Customers further accept that Pay’s Gift does not represent or warrant that the platform, system or software of the selected participating mobile applications and websites will be error-free at all times. You agree not to hold Pay’s Gift and participating merchants liable for any failures as highlighted above.

3.3 By redeeming, downloading and/or purchasing the e-Vouchers, the Customer(s) shall be deemed to have (i) agreed and consented to the collection, storage of, processing of and use of his / her personal data by Pay’s Gift for the purpose of fulfillment and conducting this Offer; and (ii) consented to receiving promotional, marketing and other publicity information from Pay’s Gift from time to time. Your personal data will be treated as confidential and shall be bound by the Personal Data Protection Act 2010 (PDPA).

3.4 The Terms and Conditions herein contained shall prevail over any provisions or representations contained in any brochure or other promotional materials advertised under this Offer.

3.5 Pay’s Gift reserves the absolute right at any time without assigning any reasons to amend, alter, modify, add, remove or vary this Terms and Conditions, wholly or in part at its absolute discretion. Changes shall become effective immediately. You are responsible to regularly check these Terms and Conditions for any updates or amendments.

3.6 Pay’s Gift reserves the right to cancel, shorten, extend, suspend or terminate the Offer at any time prior to the expiry of the Offer Period without any prior notice. For the avoidance of any doubt, any cancellation, extension, suspension or termination of the Offer at any time prior to the expiry of the Offer Period shall not entitle the Customer(s) to claim any compensation from Pay’s Gift for any and all losses or damages suffered or incurred by the Customer(s) as a result of the said cancellation, extension, suspension or termination.

3.7 Pay’s Gift, its employees and participating merchants shall not be liable for any default due to any act of natural calamities, war, pandemic, epidemic, riot, strike, lock out, industrial action, fire, flood, drought, storm, government directives or any other events which are beyond their reasonable control.

3.8 Any failure by Pay’s Gift in enforcing any of these Terms and Conditions in any instance(s) does not constitute a waiver of such term and/or condition.

3.9 Customers who would like to participate in this Offer MUST also read and understand the full terms and conditions made by the merchant(s) at the selected participating mobile applications and websites.

3.10 These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia, and parties hereby submit to the exclusive jurisdiction of the Malaysian courts.
